  18. <p>     Though often hellish for riders, New York City's subways
  19. have long been a heaven for panhandlers, who can enjoy a
  20. captive clientele of hundreds of passengers when they board a
  21. train. (Some riders, after all, are not hardened against being
  22. dunned for donations.) Because these discomforting
  23. confrontations tend to drive down ridership while increasing
  24. panhandlership, the Metropolitan Transportation Authority last
  25. year decided to enforce rules that ban begging underground as
  26. well as in other public-transport facilities.
  27. </p>
  28. <p>     Then in January a federal judge struck down the authority's
  29. new policy, ruling that it violated the beggars' right to free
  30. speech. But last week the U.S. Court of Appeals for the Second
  31. Circuit reinstated the ban, ruling that far from being a form
  32. of speech, begging seems an "assault" and a "detriment" to the
  33. common good. That's bound to cheer many a subway user, but it
  34. leaves the panhandlers without much to be thankful for.
